The Arbitration (Scotland) Act 2010 represents a modern, practicable and flexible framework for the resolution of disputes. That flexibility can be seen in the People’s Debt Tribunal.
Jubilee Scotland will be holding a People's Debt Tribunal in the Scottish Parliament on 5 October at 6 pm. Stable member John Campbell QC will be chairing the Tribunal. The possibility of cancelling the Philippines' debt to the World Bank will be argued before the Tribunal.
The event will illustrate the justiciability of sovereign debt and the types of issues involved in these disputes. Although based on an arbitral model, unlike an actual arbitration the event will conclude with a public vote, and will offer a demonstration of the merits of bringing together debtor and creditor countries in such a forum.
