Members of the Hastie Stable are continuing to develop their expertise in litigating high value damages claims, particularly those involving medical negligence.
In a much-publicised recent clinical negligence case arising from a failure of the NHS cervical screening programme, the pursuer is seeking damages of £5 million. Alan McLean QC and Donald Davidson, both of the Hastie Stable, were instructed for the defenders in a lengthy Proof on causation in which medical issues of cytology, pathology, radiology and gynaecological oncology were explored.
Other multi-million pound personal injury claims in which Alan has been involved over the course of the past six months have involved paraplegia, cerebral palsy caused by birth asphyxia and congenital brain defects. In the latter case the pursuer was represented by Leo Hofford QC, also of the Hastie Stable. Leo is regularly instructed in high value personal injury claims. He has been instructed in several birth asphyxia cases and a variety of other medical negligence claims, many of which have had the potential for multi-million pound payouts. Alan’s cerebral palsy case has involved him in detailed investigations into life expectancy in what was anticipated to be a test case on the significance of international statistical research in this field.
